40 40 Club Controversy: Jay-Z v. David Ortiz

Jay-Z opened his first 40/40 club two years ago, and he's now suing Red Sox player David Ortiz because the athlete recently opened a club named Forty Forty in the Dominican Republic. The rapper is taking Ortiz to court for $5 million now, claiming copyright infringement, among other things.

The other damages include unjust enrichment and false designation of sponsorship, according to E! Online. Jay's claim is that people will confuse the club in the DR as something he owns, and that's not cool.

The name is baseball-related, and refers to the feat of nabbing 40 home runs and 40 stolen bases in a single season. So, you might think Ortiz has a greater stake in the name, but he's only stolen 10 bases in his entire career...

Jay-Z has opened 5 more 40/40 clubs since launching the first in New York two years ago, and he wants to make sure no one thinks a 7th island establishment has been made.
